"The Supreme People's Court's Provisional Regulations Concerning Several Issues in the Execution Work of the People's Courts" Article 65 clearly stipulates:
During the execution or after the execution has been completed, if the legal document on which the execution was based is revoked or altered, the original execution body shall, in accordance with Article 233 of the Civil Procedure Law, upon the application of a party involved or by its own authority, issue an order for the execution to revert, ordering the original petitioner for execution to return the property obtained and any fruits thereof. If the petitioner refuses to return it, enforcement will be compulsory.
Indeed, the Supreme Court left an opening for "upon the application of a party involved," but the word "or" is used here, and every word in the legal provisions must be meticulously weighed.
