The judge said to commence the trail.
BAILIFF: All rise, the Court is now in session, the Honorable Judge Jonathon F. Powell presiding.
JUDGE: Please be seated. Today's case is that of Mr. Jake Donfort.Now, are there any opening statements?Prosecutor Darvis Buck please state your case.
DARVIS: Yes, your honour. Mr. Jake Donfort is arrested because of his crime of killing Miss. Kate Donfort.
JUDGE: Defense attorney Isabella Hayes please state your case.
ME: My client Mr. Jake Donfort is arrested for the wrong allegation of killing his sister Miss. Kate Donfort.
JUDGE: Please start the case.
DARVIS: Yes, your honor. Mr. Jake Donfort had killed her sister, due to some personal reasons. Isn't it Mr. Jake Donfort?
JAKE: No, sir. We were not fighting nor I had any reason to kill her. She was my sister.
DARVIS: If, it is then as I see the will of yours? Doesn't it show that you clearly have motive to kill her? Yes your honour, the will of Mr. Jake Donfort says that the property of Kate will become Mr. Jake's property once Kate dies. The main motive to kill Kate was to get his own property back to his so that he can satisfy his greedines and his own need.
ME: Objection your honour.Mr.Darvis is trying to be arrgumentive with my client.
JUDGE: Objection Sustained. Mr. Darvis please restate the phrase.
DARVIS: Jake Donfort wanted to have his good image on himself, first he named half his property to Kate, then after killing her he would get the whole and that too, there would be no one asking for the property later on.
JAKE: It is not right, we didn't had fight for any property nor I wanted to kill her for some money.
DARVIS: The can you say why we're you got into a quarrel with Kate Donfort, regarding some problem in the Duskin store of yours. As far as I know you didn't interfere in the business matter, but you adviced her something for which you had a quarrel? Answer me in Yes or No.
JAKE: Yes, we had a... (interrupts)
DARVIS: That's all your honour. I would like to call witness who have seen this happening.
JUDGE: Mr. Darvis call your first witness...
DARVIS: Thank you, your honor; I call Mrs. Louise Clapp to the stand.
(Mrs. Clapp walks up to testify, led by the bailiff)
BAILIFF: Witnesses, please stand and raise your right hand. Do each of you swear to tell the truth, the whole truth, and nothing but the truth?
DARVIS: Mrs. Clapp, would you please tell us your occupation.
Mrs. CLAPP: Yes. I am Louise Clapp. I am assistant of Kate Donfort.
DARVIS: Have you ever seen Mr. Jake Donfort argumenting with Kate Donfort?
Mrs. CLAPP: Yes.
DARVIS: Let the record reflect that the witness have seen this argument between Kate and Jake.
JUDGE: The record will so reflect.
DARVIS: When did you see Mr. Jake Donfort and Miss. Kate Donfort argumenting ?
Mrs. CLAPP: I don't remember the date but it was on the evening at 7:00 pm in the hall room.
DARVIS: What did you saw in the hall room?
Mrs. CLAPP: I saw that Mr. Jake came to Miss. Kate when we were going to leave for a meeting. Mr. Jake came to her and asked her were was she going? Then she replied for that she was going to handover the half of the companies share to other brand. For which Jake Donfort denied and it was not a argument but suggesting...
DARVIS: No more questions your honor.
JUDGE: Miss. Issabella do you care to cross-examine the witness?
ME: Yes, thank you, your honor. Mrs. Clapp, can you please complete your sentence?
Mrs. CLAPP: I was saying that Mr. Jake was suggesting her, he said just to discuss and not to take wrong descion. To which Miss. Kate was a bit angry. As Mr. Jake Donfort said this he left.
ME: Did Miss.Kate handover her shares to the other brand?
Mrs. CLAPP: No she didn't as we reached the board room she said no and asked for apologies that she don't want to give the shares to anyone.
ME: Let the record reflect that , your honour. So it is clearly stated that Kate loved her brother as well obeyed her suggestion and listened to her.
JUDGE: What are you trying to say?
ME: I want to say that if she so much listened and oboyed her brother then if her brother would ask for her property also she would happily give her.
DARVIS: Objection, your honour. There is no foundation only imagination bring brought in the case.
JUDGE: Yes, Mr. Darvis. I fail to see how this relates to the crime of kidnapping. Sustained.
ME: It is clearly related, you honour. That my opponent lawyer said that Mr. Jake Donfort would have tried to name half of his property in her name and then tried to kill her and make the property in his name.
If this would have been then why did he let her sister take the descion and once when he said to discuss and she became angry he could have arrgumented with her, he wouldn't have gave her the choice whether she want to procced worh it or not. That proofs that Kate was way too obident and listened to her brother and so was his brother, then why would he kill her even after having this much understanding. Please let the record reflect.
JUDGE: The record will so reflect.
ME: Mrs. Clapp can you please say the date when this meeting happened?
Mrs. CLAPP: I clearly don't remember but I have it noted in my Cell phone. I can say it after checking it.
ME: I would request the court for letting Mrs. Clapp to get her cell phone for the date they had the meeting.
JUDGE: Permission granted. Please bring Mrs. Clapp's cell phone to get the correct date.
ME: Thank you, your honour.
The cell phone was brought, Mrs. Clapp brought the date and the meeting timmings that she had noted and gave it to the bailiff and it was given to the judge the judge seeing this announced that it was 5 days ago to the murder.
ME: If it was 5 days before to the murder and Kate was listening to her brother and was doing the needful. So why will Mr. Jake Donfort kill her sister, when the property and profit both stayed in his hands. Please let the record reflect.
JUDGE: Record will so reflect. Do you have any other question?
ME: No more question to Mrs. Clapp.
JUDGE: You may step down Mrs. Clapp. (Bailiff escorts Mrs. Clapp to her seat). Would the prosecution like to call another witness?
DARVIS: Yes, your honour. I would like to show you the atoupsy report of Kate Donfort.
The autopsy report was handed over to the bailiff which was presented to the judge.
DARVIS: As we can see that there is no sign of any force on Miss. Kate. That mean whoever may have mudred her didn't kill her by force as well as Kate knew that person. So, it is clear that Jake can be the one to kill her cause her sister knew her killer.
ME: Objection, your honour. My opponent is constantly dragging my client without any proove that he have killed her.
DARVIS: Is it, Mr. Jake Donfort was found lying some steps away from Miss. Kate's body, he was unconscious, holding knife and blood on his hand. Doesn't it says everything.
ME: A person can be framed too, If Jake had to kill her then why will he let himself get caught.
DARVIS: What about the murder weapon his fingerprints were found on it, and that was the knife by which Kate was murdered. Don't try to waste court time false allegations.
ME: Prooving something is not false allegations Sir.
JUDGE: Oder, oder. Both the sides lawyer is requested to maintain the decoram of the court.
Darvis and me both aplogised for it. Just then the trial time was over. We waited because as it was not the end but the start. So, we should get a new date for the trail given.
JUDGE: The next hearing will be on 2nd December. Till then the court is adjourned.
We all stood up and bowed to the judge as the judge went our eyes fall on each other.
